A Crossville woman will face a decision on whether to contest charges in Cumberland County Criminal Court after a motion to suppress a search warrant based on wording was denied.
Tonya Joy Dill was indicted Jan. 5, 2023, on charges of second-offense DUI, possession of marijuana and possession of drug paraphernalia in connection with a 2020 arrest.
Crossville attorney Joseph Wyatt filed a motion to toss out the search warrant used to obtain a sample of Dill’s blood for the purpose of testing.
Contention of the motion filed by Wyatt was wording of the affidavit that “only calls for the seizure of alcohol” and not for testing of chemicals in the suspect’s system.
“It has to be specific,” Wyatt argued.
Assistant District Attorney Rachel Bateman countered the wording of the search warrant states a blood sample for search can be obtained, and is all inclusive.
Judge Gary McKenzie over-ruled the motion and continued the case to Dec. 3.
