ROCKPORT — The Massachusetts Land Court has ruled in favor of the public’s right to access at Andrew’s Point in Rockport.
Attorney General Andrea Joy Campbell on Monday said the state secured a court victory preserving the public’s right to access the coastal rock and ledges at the site.
The court ruled that a deed restriction dating back more than 135 years remains valid and enforceable.
The case involved the property at 18 Longbranch Ave., home of Rockport resident Elizabeth Fisher, who held the property was private and access should be limited to the public.
Town Administrator Mitch Vieira said the town backs the court decision.
The 1887 deed to Fisher’s property included a condition that required certain “ledges and rocks” conveyed with the property “forever remain open to the general public.”
