A 42-year-old man pled guilty to first-degree burglary in Whitfield Superior Court on Friday, March 29.
Defendant Nicholas Wayne Headrick also pled guilty to one felony count of identity fraud and one misdemeanor count of theft by taking before Conasauga Judicial Circuit Judge Jim Wilbanks.
“As to count one, burglary, the state’s recommendation is a term of 12 years, that he serve no more than 200 days from today’s date waiting entrance into the Providence men’s inpatient residential program — that is no less than six months, no more than 12 months,” stated Conasauga Judicial Circuit Assistant District Attorney Christina Antalis. “As a special condition, that he enter and complete that program along with any after care — the balance is to be served on probation.”
Headrick was also ordered to pay a $2,000 fine, complete 300 hours of community service and undergo alcohol and drug abuse counseling as part of the sentence.
“He is to complete an alternate behavior course at his own expense,” Antalis continued.
Another condition of probation bars Headrick from having any contact with a named victim in the case and the family members of that individual. Yet another probation condition orders him to turn over “any personal information or possessions” of the named victim in the case.
The theft by taking plea produced a concurrent 12-month-to-serve sentence, with the identity fraud plea producing a concurrent 12-month probation sentence.
Antalis said that Headrick would receive credit for time already served in pretrial detention.
Anna Johnson, counsel for the defendant, said that Headrick had been held in pretrial detention at the local jail since April 20, 2023.
“We would ask for him to be sentenced under the First Offender statute,” Johnson said.
Judge Wilbanks agreed to sentence Headrick under the statute, which will allow the defendant the ability to petition a court to expunge the convictions from his record pending he completes the probation portion of his sentence without any additional violations.
Wilbanks noted that the defendant faced a maximum sentence of 41 years in prison for the combined offenses.
