The sentencing hearing for a man accused of driving the wrong way on I-40 in June 2024 and striking a motorcycle, killing its driver, concluded April 9 with family members allowed to present impact statements for the court record.
Daniel Lee Miller, 47, Rockwood, pleaded guilty March 10 to vehicular homicide by intoxication and at that time received the nine-year sentence.
Reportedly, his blood alcohol content tested at .084% after the crash.
Driver of the 2013 Harley Davidson motorcycle, identified as Helene McGarvey, 61, Andersonville, TN, was dead at the scene.
The wreck occurred near the 336-mile marker not far from the Westel exit.
Troopers said Miller entered I-40 traveling east in the west lane when the collision occurred.
In other cases on the docket, the following pleas were entered:
•Donald Eugene Caswell, 57, pleaded guilty by information to a charge of theft of property of less than $1,000 and applied for judicial diversion, setting aside the plea.
He is to serve 11 months and 29 days on supervised probation and to pay restitution to be determined.
The charge stems from the theft of a Sony PS3, Nintendo Switch, controllers and we games in June 2023.
•Joshua Ryan Bullard, 33, pleaded guilty by information to a charge of attempt to possess meth and received a five-year suspended sentence to be served on supervised probation with fine and court costs waived. All items seized are forfeited.
The charge stems from a March 2025 traffic stop by Cumberland County Sheriff’s Office in Pleasant Hill during which 14.93 grams of meth was seized.
•Dylan Jakob Kempe, 25, pleaded guilty by information to a charge of felon in possession of a weapon and received a one-year sentence to be served at 100%, suspended for supervised probation.
Weapon is to be forfeited. The charge stems from a Nov. 24, 2025, arrest.
•Linda Dee King, 61, pleaded guilty to burglary and qualified for judicial diversion, setting aside the plea for a two-year probationary period.
If all terms and conditions of diversion and probation are met, King will be eligible to petition the court to have the charge removed from the record.
King is to pay $517 restitution at rate of $10 per month. The charge stems from a June 25, 2024, arrest.
•William Joseph Likes, 45, pleaded guilty to an information charging possession of meth with intent and received a 10-year sentence to serve as a Range 1 offender.
The sentence is to be served concurrently with a probation violation case in Cumberland County and a criminal court case in White County.
The charge stems from a March 18 arrest.
